By accessing, browsing, or using this Website, or by engaging Golf Design India for golf course architecture, golf course design, renovation, construction, maintenance, consultancy, or related services, you (“User”, “Client”, or “Partner”) agree to be bound by these Terms of Use (“Terms”) and all applicable laws of India. 

If you do not agree with any part of these Terms, you must immediately cease using this Website and our services.

  1. Eligibility & User Accounts

Age Requirement: By using this Website or entering into a service agreement with Golf Design India, you represent that you are at least 18 years of age and legally competent to form a binding contract under the Indian Contract Act, 1872. 

Account Responsibility: If you create an account, access a client portal, or register details on our site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. 

  1. Scope of Services & Partnerships

Golf Design India provides golf course architecture, golf course design, golf course renovation, construction consultancy, maintenance consultancy, and related golf course planning and development services. 

Statement of Work (SOW): Specific service deliverables, execution schedules, pricing, project specifications, and client obligations will be defined in individual service contracts, proposals, or Statements of Work (SOW) executed between Golf Design India and the Client. 

Partnerships: Clients, consultants, contractors, and other business partners engaging with Golf Design India will receive services according to the scope, deliverables, and obligations established in their respective agreements. 

  1. Intellectual Property Rights

Company Ownership: All content, software, visual interfaces, website code, graphics, branding logos, text, designs, drawings, photographs, and proprietary technical frameworks on www.golfdesignindia.com are the intellectual property of Golf Design India and are protected under the Indian Copyright Act, 1957 and Trademarks Act, 1999. 

Client Deliverables: Upon full payment of all outstanding invoices, ownership rights to finalized custom designs, drawings, reports, and other project deliverables produced specifically for a Client will transfer to the Client, subject to any retained rights for underlying proprietary materials, open-source modules, or third-party software licenses. 

  1. Prohibited Activities

When accessing our Website or using our services, you agree that you shall NOT: 

  • Copy, modify, distribute, reverse-engineer, or scrape any content or code from our Website without explicit written consent. 
  • Use our services for any unlawful, illegal, fraudulent, or defamatory purpose under Indian law.

Golf Design India is not liable for service disruptions, delays, technical failures, or changes instituted by these external platforms or providers, subject to applicable law and the terms of the relevant service agreement. 

Service Disclaimer: The Website and services are provided on an “as is” and “as available” basis. While Golf Design India strives for technical excellence and professional quality, we make no guarantees of uninterrupted website availability, error-free operation, or specific financial ROI, as outcomes depend on market variables and other factors outside our direct control. 

  1. Limitation of Liability

To the maximum extent permitted by applicable Indian law: 

Golf Design India, its proprietor Vijit Nandrajog, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business interruption. 

The total cumulative liability of Golf Design India for any direct claims arising out of or related to these Terms or services rendered shall be strictly capped at the total amount of fees actually received by Golf Design India from the Client for the specific service in dispute during the one (1) month preceding the event giving rise to the liability. 

  1. Termination & Suspension

Golf Design India reserves the right to suspend or terminate your access to the Website, client portals, or services immediately, without prior notice, if: 

  • You breach any material provision of these Terms or your service contract. 
  • Invoices remain unpaid beyond the specified payment due dates. 
  • Required by law enforcement or regulatory authorities in India. 
  1. Modifications to Terms

Golf Design India reserves the right to update or amend these Terms at any time to reflect legal updates or operational changes. The revised version will be published on this page with an updated effective date. Continued use of our Website or services following any updates constitutes binding acceptance of the revised Terms.
